Terms of Use

Cap-Statement.ai (the "Service") is operated by Innov8 Solutions LLC, a Washington limited liability company ("Innov8," "we," "us"). By using the Service, you agree to these Terms. If you use it for an organization, you confirm you can bind that organization.
1. The Service
The Service uses AI to generate and audit capability statements based on information you provide, files you upload, and public information about your business. You must be 18 or older to use it.
2. Your Responsibility for Content
AI-generated content and audit scores may be inaccurate or incomplete. You must review and verify all content before using it, especially identifiers (UEI, CAGE), NAICS codes, certifications, contract vehicles, and past performance. Misrepresenting your business in government contracting can carry civil and criminal penalties.
The Service is not affiliated with the SBA, SAM.gov, APEX Accelerators, or any government agency. It does not provide legal or contracting advice and does not guarantee any contract award or business outcome.
3. Your Content and Output
You own the information and files you submit. You grant us a limited license to use them only to provide and improve the Service. You confirm you have the right to submit them. Do not upload classified information, CUI, or export-controlled data.
You own the capability statements the Service generates for you. Output may resemble output generated for others.
The Service itself, including its software, templates, and scoring methodology, belongs to Innov8.
4. Acceptable Use
Do not:
- Create false or misleading statements, or content for a business you are not authorized to represent.
- Resell, copy, scrape, or reverse engineer the Service.
- Interfere with the Service's security or operation, or use it unlawfully.
5. Payment
Fees are charged per purchase and shown before checkout. There are no subscriptions or recurring charges. Payments are processed by Stripe. You may request a full refund within 7 days of purchase if you have not generated or audited a capability statement with that purchase. Request refunds at info@innov8consult.com. Otherwise, fees are non-refundable except where required by law.
6. Disclaimers
The Service and all output are provided "as is," without warranties of any kind, including merchantability, fitness for a particular purpose, accuracy, and non-infringement.
7. Limitation of Liability
To the fullest extent permitted by law, Innov8 is not liable for indirect, incidental, consequential, or punitive damages, or for lost profits, contracts, or data. Our total liability is limited to the greater of the amount you paid us in the prior 6 months or $100. Any claim related to the Service must be brought within 12 months after it arises, or it is permanently barred.
8. Indemnification
You will indemnify Innov8 against claims arising from your content, your use of output, or your violation of these Terms or the law.
9. Termination and Changes
We may suspend or end your access if you violate these Terms. We may update these Terms by posting a new version; continued use means acceptance.
10. Governing Law
Washington law governs these Terms. Disputes will be resolved in the state or federal courts of King County, Washington.
11. General
If any provision of these Terms is unenforceable, the rest remains in effect. Sections 2–3 and 6–11 survive termination.
